
In a ruling delivered on Wednesday, Justice Rahman Oshodi of the Lagos State Special Offences Court in Ikeja dismissed the request for his recusal from the ongoing trial of former Central Bank of Nigeria (CBN) Governor Godwin Emefiele.
The defense team, led by Olalekan Ojo, had sought the judge’s withdrawal from the case, claiming that his past rulings suggested a possible bias. The request was made during proceedings on Monday. However, the Economic and Financial Crimes Commission (EFCC), represented by Rotimi Oyedepo, opposed the motion, asserting that the trial had been conducted fairly and impartially thus far.
After considering both sides, Justice Oshodi ruled that the allegations of bias were without merit, stating that the defense had failed to present sufficient evidence to support their claims. In his ruling, the judge emphasized that the application for recusal lacked substance and dismissed it outright.
“The claims of bias have not been substantiated by either of the defendants,” Justice Oshodi stated, reaffirming that he would continue to preside over the case. The decision means that Emefiele’s trial will proceed under his jurisdiction.
