Court Dismisses Bail Application of Four Suspects Linked to Bello Turji

Justice Emeka Nwite of the Federal High Court in Abuja has dismissed the bail applications of four suspects connected to the notorious bandit leader, Bello Turji.

In his ruling, Justice Nwite agreed with the prosecution, led by the Attorney-General of the Federation (AGF), stating that releasing the defendants would pose a significant threat to national security. The judge emphasized that while bail is at the court’s discretion, it must be exercised judiciously, particularly in cases involving national security concerns.

The judge also granted an expedited hearing of the suspects’ trial but ultimately rejected their bail pleas. Additionally, Justice Nwite approved an ex-parte motion filed by AGF counsel David Kaswe, seeking the protection of witnesses as the trial progresses.

On February 10, the prosecution had argued that the defendants might abscond if granted bail. Kaswe highlighted the significant role the defendants allegedly played in the terrorism activities orchestrated by Bello Turji in northern Nigeria. He also warned that granting bail could lead to interference with evidence.

The prosecution argued that bail is not an automatic right, especially when national security is at stake, and urged the court to consider the gravity of the charges, the potential severity of the punishment, and the strength of the evidence against the defendants.

Kaswe further noted that some members of the group, including the key defendant, Bello Turji, remain at large and continue to pose a threat to national security.

In delivering his ruling, Justice Nwite acknowledged the constitutional principle that a person is presumed innocent until proven guilty but stated that all relevant factors, particularly the impact on national security, must be considered when deciding on bail applications.
