Kaduna Train Attack: Tukur Mamu’s Trial Faces Delay Over Missing Witnesses

The much-anticipated trial of Tukur Mamu, the alleged “terrorist negotiator” linked to the notorious 2022 Kaduna train attack, encountered a setback on Tuesday due to the absence of key witnesses.

The case, scheduled to resume before Justice Inyang Ekwo at the Federal High Court in Abuja, could not proceed as planned when the prosecution revealed complications surrounding witness availability.

David Kaswe, counsel for the Attorney-General of the Federation (AGF), informed the court that although three witnesses were still lined up to testify, one had informed the prosecution the evening before the trial that he could not make it to Abuja.

Another witness, who was expected to present vital evidence and submit exhibits, was unable to attend because the exhibits keeper was unavailable. Kaswe requested an adjournment due to these unforeseen logistical challenges.

In response, Johnson Usman, SAN, Mamu’s legal representative, expressed his disappointment over the delay but did not oppose the adjournment. Usman, however, raised serious concerns about his client’s treatment while in custody.

He claimed that Mamu, a Muslim, had been denied access to his prayer time since his detention by the Department of State Services (DSS). Usman also alleged that Mamu’s family had been prohibited from visiting him, despite a court order permitting such visits.

In addition, Usman highlighted Mamu’s health condition, revealing that Mamu’s doctor had prescribed a BP Digital Kit to monitor his blood pressure. However, DSS officers reportedly refused to allow Mamu’s family to bring the medical equipment to him. Despite assurances from DSS that the device would be provided, it had yet to be delivered, Usman stated.

Justice Ekwo, addressing the matter, instructed both the prosecution and defense to collaborate in resolving the issues and report back to the court within seven days. The trial was rescheduled for May 6, 7, and 8 for further proceedings.

This trial is part of the ongoing legal battle initiated by the federal government against Mamu, who faces 10 terrorism-related charges stemming from his alleged involvement in aiding terrorist operations, including his connection to the infamous March 2022 Kaduna train attack. Mamu denies all charges.

The federal government accuses Mamu of acting as a liaison for the Boko Haram terrorist group, allegedly collecting substantial sums of money from victims’ families in exchange for the release of hostages.

Investigations reportedly uncovered that Mamu received $420,000 and N21 million from the victims’ families, along with an additional N500,000 in ransom payments. Authorities also claim that Mamu exchanged communications with Boko Haram’s spokesperson, Baba Adamu, regarding terrorism-related activities.

Mamu has consistently pleaded not guilty, and his defense team continues to dispute the allegations. The trial continues to attract significant attention, as it carries weighty implications for efforts to combat terrorism financing and the role intermediaries play in negotiations with terrorist organizations.
