
The National Judicial Council (NJC) has declared that Justice Maurice Ikpambese remains the Chief Judge of Benue State, despite a recent resolution passed by the Benue State House of Assembly recommending his removal. In an official statement released on Wednesday, the NJC emphasized that the action taken by the state assembly is invalid and cannot stand.
The spokesperson for the NJC Kemi Ogedengbe, clarified that the decision to remove Justice Ikpambese is premature and without constitutional basis. The NJC pointed out that while a petition against the Chief Judge had been received, it is still under investigation and has not yet been deliberated upon in accordance with the council’s procedures for fair hearing.
The council further reiterated that the Nigerian Constitution provides clear guidelines for the discipline and appointment of judicial officers, all of which were disregarded in this case. It reaffirmed that the NJC holds the exclusive authority over such matters, and the House of Assembly’s actions contravene these constitutional provisions.
This development follows strong criticism from the Benue State Caucus in the National Assembly, who condemned the attempt to remove Justice Ikpambese. The lawmakers termed the action unconstitutional and illegal, asserting that it is null and void. In a bold statement, they called for immediate intervention by the NJC to prevent a constitutional crisis. They also warned that if the matter is not addressed swiftly, the National Assembly may be forced to take over the affairs of the Benue State House of Assembly, as provided for under the Constitution.
The situation has sparked concern over the potential legal and political ramifications, with stakeholders urging for a resolution in line with the principles of justice and constitutional integrity.
